ABC says Andrew Mountbatten-Windsor is suing over an 'Epstein files arrest'; RTÉ and The Independent say he wants the search warrants quashed
The former Duke of York has gone to the High Court against Thames Valley Police. The reports agree on that much. They disagree on what he is challenging and on whether the warrants came before the arrest or during it. Only The Independent says who is not paying.
What is agreed. Andrew Mountbatten-Windsor is taking legal action against Thames Valley Police, say ABC News (Australia), RTÉ News, TheJournal.ie and The Independent. TheJournal.ie and The Independent say he was arrested on 19 February and interviewed under caution.
What he is challenging. The four outlets describe it in different terms:
| Outlet | What the case is about | Warrants and arrest |
|---|---|---|
| ABC News (Australia) | "his arrest in relation to the Epstein files" | not stated |
| RTÉ News | a bid to "quash search warrants" | warrants "led to his arrest" |
| TheJournal.ie | the search warrants (headline) | not stated |
| The Independent, main report | a bid to "quash search warrants" | warrants "led to his arrest" |
| The Independent, bulletin | the same | warrants "executed during his arrest" |
The order is disputed inside one paper. Two Independent reports, filed a minute apart, put the warrants and the arrest in opposite order. The Independent says the searches began on the day of the arrest.
Who pays. Only The Independent says the King's private money will not fund the case. Its lead rests on "it is understood". Further down, it names the source as a Palace source speaking to the Press Association.
His side. 1 of 5 reports with text carries his denial: The Independent writes that he "has always strenuously denied any wrongdoing".
Not settled. Why he says the warrants were unlawful. No report gives his grounds. The hearing is in private. None of the reports says what the police documents contain. And no outlet other than The Independent confirms the funding line.
What this is about. A brother of the King is asking a High Court judge to rule that the police searches of his homes were unlawful.
How it got here. Andrew Mountbatten-Windsor is the second son of Queen Elizabeth II and the younger brother of King Charles III. From 2001 to 2011 he was the UK's special representative for trade and investment. Over the same years he was a friend of Jeffrey Epstein, an American financier convicted of a sex offence in Florida in 2008, who died in a New York jail in 2019. Andrew stepped back from public duties in 2019. In 2022 he settled a civil sexual-abuse lawsuit brought in New York by Virginia Giuffre, and he admitted no liability. According to The Independent, the King removed his dukedom and his right to be called a prince in October 2025 because of his association with Epstein.
On 19 February 2026, his 66th birthday, Thames Valley Police arrested him on suspicion of misconduct in public office. The Independent says the allegation is that he shared sensitive information with Epstein while he was trade envoy. A judge at the Old Bailey had issued warrants to search his home on the Sandringham Estate and Royal Lodge, his former home in Windsor. He was released under investigation and has not been charged.
The actors. Thames Valley Police is investigating because the Windsor home is in its area. The Palace is involved because the King pays his brother's annual allowance out of his private money. The court is involved because a judicial review is the route for testing whether a public body acted lawfully.
What is at stake. If the warrants are quashed, the police could lose material taken in the searches. If they stand, the investigation goes on as it is.
Where it stands. The Independent says a private hearing is due on Thursday 8 October before Mr Justice Hilliard. The court will also hear a police request to restrict access to some documents.
What is being argued about
- Whether the case challenges the arrest or the search warrants
- Whether the warrants led to the arrest or were executed during it
- Whether the King's private money will fund the case
- The misconduct in public office investigation and the private High Court hearing
