Irish Times says boy, 16, 'drove' the stolen car; RTÉ and TheJournal.ie say he is 'accused of driving' it

A 16-year-old with no lawyer spoke for himself at a bail hearing in Dublin Children's Court. Three reports carry almost the same text. One opens by stating as fact a charge he has not yet answered.

Anglosphere Ireland

Same hearing, two verbs. Three outlets report Monday's bail hearing at Dublin Children's Court in near-identical words. They split on whether the boy drove the car. He has not entered a plea.

Outlet Headline First mention of the driving Later in the report
The Irish Times "Boy (16) who drove stolen car" "A boy (16) drove a stolen car" "allegedly the driver"
RTÉ News "Boy accused of driving" "is alleged to have driven" "allegedly the driver"
TheJournal.ie "Teen accused of driving" opening not in the text we hold "allegedly the driver"

No lawyer. All three say he was unrepresented "due to the ongoing dispute over legal aid reforms". The judge warned him against incriminating himself.

His own words. The Irish Times and TheJournal.ie quote him: "I'm going to kill myself or I'm going to kill someone else." Both also carry the garda's "caught red-handed". RTÉ News carries neither.

"No previous convictions" is narrower. The garda accepted he had none "for serious matters dealt with at Circuit Court level". All three add that he missed probation meetings.

Bail. Granted, with a curfew, no cars without an insured driver, bail supervision, and his course and sport.

What is not settled - Whether he drove. No plea, no trial. - What the further charges are. The DPP decides, and that decides which court hears the case. - Whether these are three separate accounts. The texts match almost word for word: one account of the hearing, not three.

What this is about. A 16-year-old boy appeared in court in Dublin charged over a stolen car that, gardaí say, was driven against traffic on one of the city's main roads. He had no lawyer.

How it got here. Gardaí say a Toyota Aqua was stolen in Wexford on 18 September. In the early hours of Saturday 19 September, a Garda drugs unit on patrol in south Dublin tried to stop it. It kept going after a stinger burst its tyres. It ended on the wrong side of the Naas Road, the main road south-west out of Dublin, near the Red Cow junction. Two other youths ran from the car. The boy was arrested after a short chase on foot. On Monday he was charged with motor theft and two counts of dangerous driving.

The actors. - The boy. He is under 18, so the law bars naming him. Ireland's Children Act 2001 sends most cases involving children to the Children's Court. - An Garda Síochána, Ireland's police, objected to bail. - Judge Shalom Binchy decided bail. - The Director of Public Prosecutions decides what charges are brought. If they are serious enough, the case moves to the Circuit Court, where sentences are heavier. - Oberstown is the State's main detention centre for children. Mountjoy is an adult prison in Dublin. The boy set one against the other.

Why he had no lawyer. In Ireland the State pays private solicitors to defend people who cannot afford one. The three reports say an "ongoing dispute over legal aid reforms" left him unrepresented. They do not say what the dispute is.

What is at stake. An accused person is presumed innocent until convicted. A child speaking for himself at a bail hearing can say things that harm his own case, which is why the judge warned him. The next decision, on further charges, sets where he is tried and what he faces.

Where it stands. He is on bail. He returns next week for a check on his bail terms. He has not entered a plea.

What is being argued about

  • Whether a report may say a 16-year-old 'drove' the car before he has entered a plea
  • A child speaking for himself at a bail hearing because of the legal aid dispute
  • Which of his words each outlet chose to print
  • What 'no previous convictions' covered, and what it did not

The bias in this coverageBias

'Drove' or 'accused of driving'

The boy has not entered a plea. One report opens by saying flatly that he drove the car, then calls him 'allegedly the driver' further down. The other two hedge from the headline or the first sentence.

1 reports that open by stating he drove 2 reports that open by calling it an allegation 3 reports on the hearing

What the boy's own words did

Two reports quote the unrepresented 16-year-old saying he would kill himself or someone else. The same two carry the garda's 'caught red-handed'. The third report leaves out both.

2 reports quoting his self-harm remark 2 reports carrying 'caught red-handed' 3 reports noting he had no lawyer
Scored without the mastheads. Where the two passes differ, both are kept.

Claims and verdicts

misleading The 16-year-old drove the stolen car the wrong way along the Naas Road.
The Irish Times states in its headline and first line that the boy drove the car, but further down its own report calls him 'allegedly the driver', and he has not yet entered a plea. RTÉ News and TheJournal.ie report the same hearing and treat it as an allegation throughout: 'accused of driving' and 'alleged to have driven'.

All three reports carry the charges and say more are likely. Their wording is almost identical, so they read as one court account rather than three separate checks.
