Jerusalem Post says 'all nine justices recommend' the Balad leader quit; Haaretz says the chief justice proposed it and the bench is 'inclined' to uphold his ban
Israel's Supreme Court heard appeals on 1 October against bans on Ra'am, the Joint List, Balad leader Sami Abu Shehadeh and MK Ofer Cassif. Four reports describe the hearing with four different strengths of message. None of them reports a ruling.
What happened. An expanded panel of nine justices heard appeals against the Central Elections Committee's decision to keep Arab parties and two MKs out of the next Knesset election, Arutz Sheva reports. Three reports agree that the court told Balad leader Sami Abu Shehadeh it would be better if he withdrew.
Where they differ. The reports disagree on who made the recommendation and how strongly it was put.
| Outlet | Who acts | How strong |
|---|---|---|
| The Jerusalem Post | "All nine justices" | Recommend he drop his candidacy, answer due by Friday morning |
| Haaretz | President Isaac Amit | A proposal; he "cited the judges' inclination to uphold his disqualification" |
| Arutz Sheva | "Supreme Court" | Headline: "Quit". The text says only that the panel "considers" the decision |
| Al-Modon | The court | Appeals by Arab lists and candidates who were "excluded"; no recommendation reported |
Who is missing. None of the four reports quotes Abu Shehadeh, Ra'am, the Joint List or Cassif. We hold no report from an Arabic-language outlet inside Israel.
What is not settled - No ruling has been reported on any of the four bans. - Only Haaretz says the bench leans towards upholding the ban. We cannot confirm it. - Only the Jerusalem Post gives the Friday deadline. - Whether the recommendation came from all nine justices or from the president alone. - Nothing we hold says how the court will rule on Ra'am, the Joint List or Cassif.
What this is about. Israel's Supreme Court is deciding whether three parties and two named politicians may stand in the coming Knesset election, after the body that runs the election barred them.
How it got here. Israel's parliament, the Knesset, is elected on national party lists. Before each election the Central Elections Committee approves the lists. That committee is made up mostly of representatives of the parties already in the Knesset, and a Supreme Court justice chairs it. Under Basic Law: The Knesset, it can bar a list or a candidate who rejects Israel as a Jewish and democratic state, incites to racism, or supports armed struggle against Israel. Its decisions go to the Supreme Court. The committee has voted to bar Arab parties before several past elections, and the court has overturned most of those bans, including Balad's.
The actors. - Balad is an Arab nationalist party that argues Israel should be a state for all its citizens and not a Jewish state. Sami Abu Shehadeh leads it. - Ra'am (the United Arab List) is an Islamist Arab party. In 2021 it became the first Arab party to join an Israeli governing coalition. - The Joint List is an alliance of Arab-led parties. - Ofer Cassif is a Jewish MK from the Arab-Jewish party Hadash. - Isaac Amit has been president of the Supreme Court since January 2025.
What is at stake. Arab citizens make up about a fifth of Israel's population. If the bans stand, their main parties could be missing from the ballot. If the court overturns them, the committee's decision is undone, as it has been before.
Where it stands. On 1 October a panel of nine justices heard the appeals. The reports we hold describe a recommendation that Abu Shehadeh withdraw. None reports a ruling.
What is being argued about
- Who made the recommendation to Abu Shehadeh: all nine justices, or the court's president
- Whether the bench leans towards upholding his ban, which only Haaretz reports
- The bans on Ra'am, the Joint List and MK Ofer Cassif, which none of these reports says have been decided
- Why none of the barred candidates is quoted in any report we hold
