Sullivan sues the BBC: the Guardian says 39% of West Ham and 'libel and malicious falsehood'; the Independent says 40% and 'libel and slander'
David Sullivan has filed a High Court claim against the BBC over a Panorama film in which seven women accused him of sexual exploitation. Two reports agree on the sum, about £150m. They do not agree on what the claim alleges or on how much of West Ham he owns.
The claim. David Sullivan filed a High Court claim against the BBC on Thursday, the Independent reports, citing court records. The Guardian puts the sum at £150m. The Independent says "more than £150m", citing his lawyers, GSP Law. He denies the allegations. Both reports say the BBC declined to comment.
Where the two reports differ.
| The Guardian | The Independent | |
|---|---|---|
| What the claim alleges | "libel and malicious falsehood" (the claim, as first seen by the Telegraph) | "libel and slander" (court records) |
| His West Ham stake | 39%, largest shareholder | 40%, second-largest shareholder |
| Headline word for the allegations | "sexual misconduct claims" | "'defamatory' allegations", his word |
| How he is introduced | "West Ham co-owner and former pornographer" | "former West Ham co-chairman" |
What only one report carries. The Guardian quotes the claim itself. It says the film caused "grave, catastrophic, and irreparable harm". Only the Independent reports that Essex Police "received some contact" after the broadcast and that its inquiries are ongoing. It also reports that the Independent Football Regulator's review of whether Sullivan is fit to own a club is "active and ongoing".
What is not settled. The Independent says no claim documents are publicly available, so we cannot check exactly what the claim alleges. Neither report explains the gap between 39% and 40%. The BBC has not said whether it will defend the programme. No court has ruled on whether the allegations are true.
What this is about. A businessman who co-owns a football club is suing Britain's public broadcaster over a documentary that accused him of sexual exploitation.
How it got here. David Sullivan made his money in the adult industry and in the Sport tabloids, the Daily Sport and the Sunday Sport. In 2010 he and David Gold bought West Ham United, a London club. In 2023 the Football Association opened a safeguarding inquiry after a complaint. Sullivan says the complaint concerned an event in 1981 that "never happened". He agreed to limits on his contact with the club's women's and youth teams. In June 2026 the BBC and the Times published the accounts of seven women. They said he abused his power as a newspaper owner in the 1980s and 1990s, when they were looking for work. Panorama broadcast their accounts. Sullivan resigned as co-chair and promised to sue.
Who is involved. Sullivan, now 77, says the claims are "factually incorrect and entirely false". The BBC is funded by the licence fee and governed by a Royal Charter. Panorama is its main investigative programme. The BBC is already defending a claim from Donald Trump over a separate Panorama edit. Essex Police and the Independent Football Regulator are both making inquiries.
What is at stake. In England and Wales, a person suing for libel must show that a publication caused, or is likely to cause, serious harm to their reputation. A broadcaster can defend itself by proving the claims are substantially true, or that publishing them was in the public interest. Malicious falsehood is a separate claim. It requires proof that a statement was false, was made with malice and caused financial loss. If the case goes to trial, the women's accounts could be tested in court. If the BBC loses, that will affect how it reports on powerful people.
Where it stands. The claim was filed on 1 October. The BBC has not responded in public.
What is being argued about
- What the claim alleges: libel and malicious falsehood, or libel and slander
- How much of West Ham Sullivan owns: 39% or 40%
- Whose word goes in the headline: 'defamatory' or 'sexual misconduct'
- The police and football regulator inquiries running alongside the claim
