The Irish Times says 'loyalist gunmen', TheJournal.ie says 'loyalist terrorists': son of 1994 Dublin victim sues Garda watchdog
Martin Doherty's son has started legal action against Fiosrú, Ireland's police ombudsman, saying it has not investigated Troubles incidents. The Irish Times and TheJournal.ie describe his father's killing differently. RTÉ News names neither the dead man nor his son.
The action. The son of Martin Doherty has started legal action against Fiosrú, Ireland's police ombudsman. The Irish Times, TheJournal.ie and RTÉ News all say the action is about a lack of investigations into Troubles incidents. Doherty was killed at the Widow Scallan's pub in 1994.
Three reports, three descriptions.

Why the words matter. "Murdered" is a legal finding. "Terrorists" is a political label. TheJournal.ie states both without attributing them. The Irish Times describes the act instead: "shot dead" by "gunmen". RTÉ's opening sentence names no one. It says legal action "is being taken" but not by whom.
What is not settled. - None of the three reports gives the son's name. - None says which court is hearing the case, what the legal grounds are, or what the son wants the court to order. - None carries a response from Fiosrú. - Each report we hold is a single sentence. Anything the full articles say beyond that, we have not read.
What this is about. A family is going to law to try to make Ireland's police watchdog investigate a killing from the Troubles. The killing happened in the Republic of Ireland, not in Northern Ireland.
How it got here. The Troubles were the conflict over whether Northern Ireland should stay in the United Kingdom. It ran from the late 1960s until the Good Friday Agreement of 1998. Republican paramilitaries such as the IRA fought to end British rule. Loyalist paramilitaries fought to keep it. The British Army and the Royal Ulster Constabulary were also involved. Most of the killing was in Northern Ireland, but some attacks took place in the Republic, including in Dublin. Martin Doherty was killed at the Widow Scallan's pub in 1994. That was the year the IRA and the main loyalist groups declared ceasefires.
The actors. - Fiosrú, the Office of the Police Ombudsman. It replaced the Garda Síochána Ombudsman Commission in 2025. It investigates complaints about the Republic's police force, An Garda Síochána. - Northern Ireland's own Police Ombudsman. It has existed since 2000 and has examined historical killings. The Republic has had no equivalent route for the Troubles. - The British and Irish governments. Both are in a long dispute over legacy cases. The UK's Legacy Act of 2023 closed off most new Troubles inquests and civil actions. Ireland took the UK to the European Court of Human Rights over it. The Labour government elected in 2024 said it would repeal and replace the Act.
What is at stake. The question is whether a watchdog that oversees today's Irish police must look back at a Troubles killing in the Republic. If it must, other families could follow the same route. If it need not, the Republic's side of the legacy question has no watchdog route. The reports do not say what the son says the gardaí did or failed to do.
Where it stands. The three reports, published on 22 September 2026, say the action has been started. None of them gives a hearing date.
What is being argued about
- Whether Ireland's police ombudsman must investigate Troubles killings that happened in the Republic
- The 1994 killing of Martin Doherty at the Widow Scallan's pub in Dublin
- How outlets describe the killers: 'loyalist gunmen' or 'loyalist terrorists'
- What the reports leave out: the son's name, the court and the grounds
