TheJournal says the Derry murderer got 15 years, the Irish Times says life
Gary Anderson, 29, failed to return from his father's funeral on 14 September. Gardaí arrested him near Buncrana, Co Donegal, on Wednesday. The two reports we hold disagree on his sentence, and only one says a court ordered his release.
The arrest. Gardaí arrested Gary Anderson, 29, at a property in the Buncrana area of Co Donegal shortly before 2pm on Wednesday, the PSNI says. A Garda spokesperson told the Irish Times it was "a planned operation". The PSNI says it is working to return him to custody. It has not said how or when.
The escape. Anderson was let out of prison for his father's funeral on 14 September and did not go back. He was jailed in 2023 for the 2018 murder of Karol Kelly, a father of five, in Derry. Both reports name Kelly.

Who answers for it. TheJournal says Long apologised to the Kelly family and ordered an independent review. Eastwood, the SDLP MP for Foyle, told it "confidence has been damaged in the institutions involved". The Irish Times carries no political voice.
What is not settled. - Whether 15 years is the minimum term of a life sentence. Neither report says. - Only TheJournal reports the court order. We hold no second account of it. - How he will be returned across the border, and when. - Who will lead the review, and when it reports.
What this is about. A man serving a sentence for murder in Northern Ireland was let out for a funeral, crossed into the Republic of Ireland, and was arrested there nine days later.
How it got here. Karol Kelly, a father of five, was stabbed to death in Derry in 2018. Gary Anderson and his brother Sean were convicted of his murder and jailed in 2023. In Northern Ireland, as in England and Wales, murder carries a mandatory life sentence. The judge sets a minimum term that must be served before release on licence can even be considered. That is the likely source of the two figures in the reporting, but neither report says so.
Prisoners can ask for short compassionate leave, for a family funeral for example. When their father died this September, both brothers asked. TheJournal reports that the prison authorities refused both, and a court then allowed Gary's release with conditions. He did not return on 14 September.
The actors. The Northern Ireland Prison Service runs the jails, including Maghaberry in Co Antrim. It answers to the Department of Justice, a devolved ministry at Stormont since 2010, now led by Naomi Long of the Alliance Party. The PSNI polices Northern Ireland. An Garda Síochána polices the Republic. Derry sits on the border, and Buncrana, on Co Donegal's Inishowen peninsula, is a short drive away. Colum Eastwood is the SDLP MP for Foyle, the Westminster seat that covers Derry.
What is at stake. Two police forces and two legal systems had to work together to find him. Since Brexit, handing a wanted person from Ireland to the UK runs through the arrest-warrant arrangements in the EU–UK trade agreement and the Irish courts. The review Long ordered will test how a release refused by the prison came to be granted, and who was told what.
Where it stands. Anderson is in Garda custody in Donegal. The PSNI says it is working to bring him back and will give an update.
What is being argued about
- Whether Gary Anderson's sentence was 15 years or life
- A court overturning a prison refusal of funeral leave
- PSNI and Garda cooperation across the border
- The justice minister's apology and independent review
