TheJournal.ie says the government chose a commission over a public inquiry; RTÉ says a scoping report recommended it

Ireland will investigate children's spinal care at Children's Health Ireland through a commission of investigation, not a public inquiry. The reports we hold differ on who made that call. Only one says what parents wanted.

Government to carry out commission of investigation into spinal care instead of public inquiry

Anglosphere Ireland

The decision. A commission of investigation will examine children's spinal and orthopaedic care at Children's Health Ireland (CHI). Both outlets agree on that. TheJournal.ie says the government "accepted the recommendation". RTÉ News says a "Government backed scoping report" recommended the commission.

Who chose.

Outlet Who acts What was passed over
TheJournal.ie (news report) the government, "instead of public inquiry" a public inquiry
TheJournal.ie (evening round-up) "The government accepted the recommendation" a public inquiry
RTÉ News a scoping report "has recommended" "a public tribunal"

The parents. Only TheJournal.ie mentions them: "A public inquiry is the route favoured by many of the parents of affected children." It gives no number and quotes no parent. The part of RTÉ's report that we hold does not mention parents.

The words. RTÉ calls the rejected route a "public tribunal". TheJournal.ie calls it a "public inquiry". In Irish law these are not always the same thing.

What is not settled.

  • How many children the commission will cover. No report gives a number.
  • Who wrote the scoping report, and when it was delivered.
  • The commission's terms of reference, its chair and its timetable.
  • How many parents wanted a public inquiry, and whether they will accept a commission.
  • We hold only one sentence from each of the two news reports.

What this is about. Ireland is setting up an official investigation into how Children's Health Ireland treated children with scoliosis and spina bifida. Children's Health Ireland runs the country's national children's hospitals. The question now is what kind of investigation it will be.

How it got here. Children's Health Ireland was formed in 2019. It brought the Dublin children's hospitals at Crumlin, Temple Street and Tallaght under one body. Scoliosis is a curve in the spine. Spina bifida is a condition of the spine that is present from birth. Both can need major surgery in childhood, and a delay can make a curve worse. For years, waiting times for children's spinal surgery have been a political issue in Ireland. In 2023 it emerged that implants not approved for clinical use had been used in spinal surgery on children at Temple Street. External reviews of the hospital group's spinal service followed. Families pressed for a full statutory investigation, and a government-backed scoping report was set up to advise on what form it should take.

The actors. The government decides which kind of statutory investigation to set up. Children's Health Ireland runs the hospitals and is the body under examination. The scoping report advised the government. The parents of affected children are the families the investigation is meant to answer.

What is at stake. Ireland has two main routes. A tribunal of inquiry sits in public and can make formal findings of fact. A commission of investigation is set up under a 2004 law. It usually takes evidence in private and is often faster and cheaper. The choice decides whether families hear the evidence in the open.

Where it stands. TheJournal.ie reports that on 28 September 2026 the government accepted the recommendation for a commission of investigation. None of the reports we hold carries its terms of reference.

What is being argued about

  • Who chose a commission of investigation over a public inquiry
  • What parents of affected children wanted
  • What a commission can and cannot do in public
  • What no report tells us: how many children were affected
