Breitbart says 'gang rape case', the Post says 'rape allegations', National Review says it 'may not be a rape'

Gov. Kathy Hochul has handed a 2024 sexual-assault case at Cornell to Attorney General Letitia James. The 12 reports we hold use three different terms for the case and four different verbs for what the governor did.

United States United States

What happened. New York Gov. Kathy Hochul has made Attorney General Letitia James special prosecutor in a 2024 sexual-assault case at Cornell. The Washington Examiner, The Washington Post, Fox News, Breitbart and The Hill all report it. The Examiner says the county district attorney had reopened the case days earlier.

What it is called. 5 of 12 headlines say "rape case", "rape investigation" or "rape probe" without "alleged". 4 say "allegations" or "alleged". National Review's standfirst says, in its own voice: "The Cornell case may not be a rape."

Outlet The case What Hochul did
Breitbart "Gang Rape Case" appointed "disgraced" James
Fox News "alleged ... gang rape" named James special prosecutor
Reuters "rape investigation" "attacks" law enforcement
The Washington Post "rape allegations" "slams" the district attorney and police
The Hill "rape probe" "stops short" of seeking resignations
National Review "may not be a rape" —

One side, carried once. Only the Examiner gives the district attorney's reason for not bringing charges at first. It reports that he has said her first sworn statement "differed substantially" from her later lawsuit. No report we hold sets out either statement, so we cannot check his claim.

What is not settled - Whether anyone is charged. The Examiner says James's office can take the case to a grand jury. - Whether the district attorney stays. Hochul said: "I don't have enough information at this time." - What Cornell's survey measured. The Hill reports a figure of 35% of undergraduate women. The text we hold gives no method or sample size.

What this is about. A former Cornell student says she was sexually assaulted at a fraternity house in 2024. No criminal charges followed. Now the state's chief prosecutor has taken over the case.

How it got here. Cornell is an Ivy League university in Ithaca, in Tompkins County, upstate New York. Court papers name the student only as Jane Doe. The Washington Examiner reports that she says the assault happened at the Chi Phi fraternity house in October 2024. She reported it to Cornell's own police in November 2024. Cornell suspended the chapter and ran a Title IX inquiry. That is the campus process federal law requires for sex discrimination, including sexual assault. It led to discipline for students. It is separate from a criminal case, and no charges were brought. In September 2026 she sued Cornell, seven current or former students, fraternity and sorority groups and a local bar. On 28 September the district attorney reopened the criminal case because of new information in the lawsuit. Days later the governor took the case away from him.

Who is in it. - Kathy Hochul, a Democrat, has been governor of New York since 2021. New York law lets a governor direct the attorney general to take over a prosecution. - Letitia James, a Democrat, has been New York's attorney general since 2019. Her office now runs the investigation. - Matthew Van Houten is the elected Tompkins County district attorney, who handled the case first. - Cornell ran the campus inquiry, and its police took the first report.

What is at stake. For the accused students: whether they face a criminal case. For the woman: whether a prosecutor tests her account in court. For the state: a change in the law. The Washington Post and the Examiner report that Hochul wants the law to stop treating a victim who chose to drink or take drugs differently when deciding whether she could consent.

Where it stands. James's office has opened a criminal investigation. No one has been charged.

What is being argued about

  • Whether to call it a rape, an allegation, or neither
  • Why the district attorney did not bring charges in 2024
  • Whether the governor criticised, attacked or held back
  • New York's rule on voluntary intoxication and consent
