The Hill says LGBTQ students lose Title IX protections; Fox News says Trump-era rules on girls' sports are restored
On Monday the Education Department rescinded the Biden administration's 2024 Title IX rule and sent schools back to the 2020 rules. Two outlets describe the same change as being about different people.
What happened. The Education Department announced on Monday that it has formally rescinded the Biden administration's 2024 Title IX rule, The Hill and Fox News report. Fox News says Education Secretary Linda McMahon made the announcement. The Hill says schools must now follow the rules issued under the first Trump administration in 2020.
Where they agree. Both reports say the 2024 rule is gone and the 2020 rules are back. Neither contradicts the other on the facts.
Where they differ. Each report says the same act is about a different group.
| The Hill | Fox News | |
|---|---|---|
| Headline verb | "rescinds Title IX protections" | "rescinds Biden Title IX rule, restores Trump-era regulations" |
| Who it is about | "LGBTQ students" | "girls sports and gender identity" |
| What the 2024 text was | an "interpretation" | a "rule" |
| Effect stated as | what "the department says" | the report's own words |
What both leave out. Neither report quotes a student, a school, a parent or anyone challenging the change. Neither says how many students or schools are affected.
What is not settled. - What the department says the change will do. The Hill's text breaks off at "which the department says will". We hold only its opening lines. - Whether anyone will challenge the rescission in court. Neither report says. - When schools must comply. Neither report gives a date.
What this is about. Which students a federal law requires schools to protect from sex discrimination.
The law. Title IX of the Education Amendments of 1972 bans discrimination "on the basis of sex" in any school or college that receives federal money. Congress wrote the ban. The Education Department writes the regulations that say what it means in practice, and each administration has rewritten them.
How it got here. - 2020. The first Trump administration, under Education Secretary Betsy DeVos, issued rules focused on how schools handle complaints of sexual harassment and assault. - 2020, separately. In Bostock v. Clayton County, the Supreme Court ruled that firing someone for being gay or transgender is sex discrimination under Title VII, the employment law. - 2024. The Biden administration relied on that reasoning to issue a new Title IX rule. The rule extended protection to students on the basis of sexual orientation and gender identity. It did not decide who may play on which sports team. A separate proposal on athletics was withdrawn in December 2024. - 2024–2025. Republican-led states sued. Federal courts blocked the 2024 rule in many states, and in January 2025 a federal judge in Kentucky struck it down. The second Trump administration then said it would enforce the 2020 rules.
The actors. The Education Department, led by Secretary Linda McMahon, writes and enforces the rules. Schools and colleges must follow them or risk losing federal funding. The two reports put different groups at the centre of the change: The Hill names LGBTQ students, and Fox News names girls' sports.
What is at stake. Whether a school that treats a student differently for being gay or transgender is breaking federal law.
Where it stands. On Monday 28 September 2026 the department announced the formal rescission of the 2024 rule. The Hill reports that schools must now follow the 2020 rules.
What is being argued about
- Whether the change removes protections or restores earlier rules
- Who the change is about: LGBTQ students or girls' sports
- The return to the 2020 Title IX rules
- Who is affected: no student or school is quoted
