Smith 'will not be silenced', says the Post; the Examiner leads with a senator's insult, Fox with its own journalists' records
Jack Smith, the former special counsel, spent more than four hours before the Senate Judiciary Committee. The Washington Post led with his defence. The Washington Examiner led with Republican senators' attacks. Fox News led with a claim that his investigation swept up nearly 50 journalists.
Four outlets, four different hearings. Jack Smith testified under oath to the Senate Judiciary Committee on Tuesday for more than four hours, The Hill reports. Each outlet puts a different speaker first.

| The Washington Post | Smith: he will not "be silenced by continued threats of prosecution" |
| Washington Examiner | Sen. John Kennedy (R-LA): "You make me want to throw up in my mouth" |
| The Hill | Sen. Eric Schmitt (R-MO) "seems to confuse basketball teams" |
| Fox News | Smith's investigators obtained records of "nearly 50 journalists" |
The basketball exchange. Schmitt asked whether Smith attended an Atlanta Hawks game on 3 Feb 2024, the Washington Examiner reports. Smith said he saw Iowa play Maryland. The Examiner prints the result: Iowa won 93-85 in College Park. Schmitt said messages still raised questions about coordination with prosecutors in Atlanta. The two reports on the exchange both hedge the mix-up, one with "apparently" and the other with "seems to".
Phone records. Smith said he sought "toll records, non-content records" of lawmakers, the Examiner reports. It names Sens. Blackburn, Hagerty and Hawley.
What is not settled - Only Fox News carries the figure of nearly 50 journalists. No other report we hold confirms or contradicts it. - Only the Examiner names the senators whose records were sought. - For most of the reports we hold, we have only the headline and the opening lines. We cannot see what they left out. - We could not read Reuters or MSNBC.
What this is about. A Senate committee questioned the prosecutor who charged Donald Trump with federal crimes. The same committee is now investigating that prosecutor's own investigation.
How it got here. On 18 November 2022, Attorney General Merrick Garland appointed Jack Smith as special counsel. Trump had just announced a new run for president. Smith brought two federal cases in 2023. One was about classified documents kept at Trump's Mar-a-Lago home. The other was about efforts to overturn the 2020 election. Neither case reached trial. A federal judge in Florida dismissed the documents case in July 2024. Trump won the November 2024 election. Smith's office then dropped both cases, citing a Justice Department policy against prosecuting a sitting president. Smith left the department in January 2025.
A separate case was brought in Georgia by Fani Willis, the Fulton County District Attorney. Her relationship with Nathan Wade, the prosecutor she hired to lead it, became a controversy in early 2024. Republicans have long asked whether the Biden White House and the Justice Department coordinated with local prosecutors, the Washington Examiner reports. That question is behind Schmitt's questions about the basketball game.
Who is involved. Republicans hold the Senate majority and chair the Judiciary Committee. They are scrutinising the tactics Smith used, including his subpoenas for lawmakers' phone records. Smith says he decided on his own, based on strong evidence. Democrats on the committee pushed back, among them Amy Klobuchar, who said Smith deserved an apology.
What is at stake. Smith told senators he faces "continued threats of prosecution" from the president, The Washington Post reports. Republicans argue more widely that federal law enforcement was used against Trump, and the hearing adds to that argument.
Where it stands. This was Smith's second appearance before Congress, The Hill reports. The committee's inquiry continues.
What is being argued about
- Whether Smith consulted Garland, and whether Garland checked with Biden
- Schmitt's claim that Smith attended a Hawks game in Atlanta
- Subpoenas for Republican senators' phone records
- Records covering journalists' communications with officials
