Four outlets, one injunction, two names for the order it blocked
A federal judge in Maryland blocked Trump's new birthright citizenship order on Wednesday. The Washington Examiner headlines it as a ban on "birth tourism" and is the only report saying two orders were signed; Reason quotes the order reaching four groups; AP puts the birth-tourism label in the administration's mouth.
The ruling. U.S. District Judge Deborah Boardman, in Maryland, granted a preliminary injunction on Wednesday against Trump's 6 August executive order. Reason alone names the case, Casa, Inc. v. Trump, and calls it the first ruling on the new order.
Two names, and where the judge's appointment sits.
| Outlet | Calls the blocked order | Where "Biden-appointed" sits |
|---|---|---|
| AP | a bid to end automatic citizenship | fourth paragraph, in a quote attribution |
| Reason | a birthright citizenship order reaching four groups | never raised |
| Fox News | an order limiting birthright citizenship | its opening words |
| Washington Examiner | an order "banning so-called 'birth tourism'" | second sentence, before her name |
Checked. Calling the blocked order a birth-tourism ban is misleading: birth tourism is one of four groups the order reaches, and AP marks the label as the administration's word. Fox carries "almost certainly unconstitutional" without Boardman's own limit, "as applied to the certified class". The Washington Examiner's two signed orders is unverified — no other report we hold says there were two.
The two bias readings differ on one count: one reads a single report as putting the appointment in the opening sentence, the other counts two putting it ahead of her name. Same reports, different rule.
Not settled. One order or two. Whether the order reaches children born before 19 February 2025 — Reason says the order is silent on it, and that government lawyers' assurance "may not be credible". No report we hold quotes anyone the order would apply to.
What this is about: whether a US president can decide by order that some children born on American soil are not American citizens.
How it got here.
- 1868. The 14th Amendment was ratified after the Civil War. Its Citizenship Clause makes citizens of everyone "born or naturalized in the United States, and subject to the jurisdiction thereof." In 1898, in United States v. Wong Kim Ark, the Supreme Court read it to cover the US-born child of immigrant parents. The accepted exceptions have been narrow, such as the children of foreign diplomats.
- 20 January 2025. On his first day back in office, Donald Trump signed an order denying citizenship to children of parents in the country unlawfully or on temporary visas. It was set to apply from 19 February 2025. Immigrant families and advocacy groups sued. Courts certified a class covering those children.
- 30 June 2026. In Trump v. Barbara, the Supreme Court ruled 5–4, as Fox News reports, that those children are "citizens at birth."
- 6 August 2026. Trump signed a new order. Reason lists four groups it reaches: children of parents deemed "alien enemies", children of foreign-government or international-organisation employees, children linked to "birth tourism", and children born in American Samoa. American Samoa is a US territory whose people are US nationals but not citizens by statute. The administration says the new order sits inside the exceptions the Court left open.
The actors.
- The Trump administration and the Justice Department are defending the order.
- CASA, an immigrant-rights group based in Maryland, and the families in the certified class are challenging it.
- Judge Deborah Boardman of the federal district court in Maryland also ruled on the 2025 order.
What is at stake. If the order stands, some US-born children would be denied citizenship and the documents that come with it. If it falls, the Supreme Court's June ruling limits what any president can do by order on this question.
Where it stands. The injunction is preliminary. It holds while the class action goes on. Appeals from Maryland go to the Fourth Circuit. The Washington Examiner reports that Attorney General Todd Blanche said the government would go back to the Supreme Court if it had to. Children born in American Samoa, and any born before 19 February 2025, are outside the protected class.

- One executive order, or two
- Where each report puts "Biden-appointed"
- Who the injunction protects, and from when
